OC 322/2017 - The Oil and Gas Conservation Amendment Regulations, 2017 (Minister of Energy and Resources)
Description:

Title: The Oil and Gas Conservation Amendment Regulations, 2017

Minister: Minister of Energy and Resources

Summary: (1) Subject to subsection (2), these regulations come into force on the day on which section 1 of The Oil and Gas Conservation Amendment Act, 2017 comes into force.

(2) If section 1 of The Oil and Gas Conservation Amendment Act, 2017 comes into force before the day on which these regulations are filed with the Registrar of Regulations, these regulations come into force on the day on which they are filed with the Registrar of Regulations.

These regulations will amend RRS O-2 Reg 6 to:

  • Introduce a $40 per kilometer levy on licensed pipelines, other than flowlines (whose regulatory costs are accounted for under the existing levy formula), pipelines subject to a discontinuation and abandoned pipelines.
  • Introduce a $20 per kilometer levy on pipelines subject to a discontinuation, as defined in The Pipelines Regulations, 2000.
  • Introduce a $25 levy on inactive wells and other currently exempt wells (known now as Class 9 wells).
  • Alter the formula for calculating the Administrative Levy so as to provide future flexibility should there be a need to apply different annual adjustment factors to the well or pipeline levy components to reflect regulatory costs.
  • Incorporate some minor changes/clarifications to definitions and to update references to The Fire Safety Act and The Environmental Management and Protection Act, 2010.
